The President of the Supreme Court of Cassation prof. Lasar Gruev appointed for the first quarter of 2009 the hearings for adoption of 6 interpretative judgments.
The first hearing is appointed for 19 January, starting at 10:30, at Hall ¹16 at the Palace of Justice at the request of the President of the Supreme Court of Cassation. The general assembly of the commercial college is due to adopt interpretative judgment on “When the implemented parallel import by third parties represents infringement of right to registered mark, in compliance of art.73, par. 1, in pursuance of art. 13, par. 2, point 3 of the “Marks and Geographical Indications Act”.
The second hearing for adoption of interpretative judgment is appointed for 26 January 2009 starting at 15:00 at Hall ¹15 of at Palace of Justice at the request of the President of the Supreme Court of Cassation. The general assembly of the civil and commercial college is due to adopt interpretative judgment on “Following the granting of injunction in compliance of art.390 of the Code of Civil Procedure, in pursuance of art.22, par. 2 and of Criminal Assets Forfeiture Act, when is the initial moment from which the term of limitation is due for submission of motion as referred to in art.28, par.1 of the abovementioned act”.
